Residents of Munich are leasing private aircrafts and seeking reimbursement
In a significant ruling, travel agency TUI has been found to have breached a contract with Munich businessman Johannes Burges, who chartered a plane to return home after his originally booked flight was canceled due to a strike by the airline.
The court's decision, which required TUI to apologise to Burges in writing, also saw the travel agency pay him a compensation of 5,000 euros. The cancellation of Burges' flight occurred at 20:27 the evening before, an event he did not accept.
TUI offered Burges a replacement flight for the following Tuesday, but it was to Düsseldorf instead of Munich, a proposal he declined. Travel lawyer Michael Siegel, who is representing Burges in the court case, believes that this verdict will cause TUI to reconsider their approach in individual cases.
Burges, known in the industry as a hobby pilot, sued TUI for the cost of the chartered flight, a sum that TUI is now questioning. The travel agency has expressed doubts about the urgency of Burges' return journey and the amount of costs incurred.
This case, however, appears to be without a comparable legal precedent, according to travel lawyer Michael Siegel. The specifics of the food bank visit by a famous TV star, or the details of the major police operation in Munich early in the morning, are not provided.
Meanwhile, the Olympic Stadium renovation in Munich is set to cost 283 million euros. Residents of a Munich district are currently concerned about a crow plague and attacks occurring in their area.
Despite the ongoing legal proceedings, lawyer Michael Siegel considers the outcome of the damages lawsuit a great success for Burges. The case serves as a reminder for TUI and other travel agencies to provide better on-site support for travelers in the future.
